Welcome to ViralF (accessible via https://viralf.com). These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, dashboard, and the influencer marketing services provided by ViralF ("Company", "we", "our", or "us").
By accessing the ViralF platform, creating an account, or participating in any influencer marketing campaign, you agree to be bound by these Terms. If you do not agree, please do not use our platform.
1. Eligibility & Account Registration
- Creators/Influencers: To register as an influencer on our platform, you must be at least 18 years of age (or have explicit parental/legal guardian consent) and possess an authentic social media account (e.g., YouTube, Instagram).
- Brands/Advertisers: Brands must provide accurate corporate credentials and have the authority to post campaigns and allocate budgets.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials, including OAuth tokens or passwords linked to your account.
2. Influencer Deliverables & Platform Rules
When a Creator applies for and is accepted into a campaign via the ViralF platform, they explicitly agree to the following core operational ledger rules:
- Permanence of Content: All campaign deliverables (Reels, Shorts, Videos, or Posts) must remain permanent on the influencer's linked social media profile. Deleting, archiving, or hiding the content without written permission from ViralF will result in an automatic system blacklist and forfeiture of payout.
- Timeline Enforcement: Deliverables must be uploaded, submitted, or executed through the dashboard within five (5) working days from the date of receiving product allocations or sample shipments.
- Authenticity Assurance: Creators warrant that their target profile engagement, reach, and follower metrics are 100% organic and authentic. The use of fake reach packs, engagement pods, bots, or automated manipulation systems is strictly prohibited.
3. Campaign Performance, Modification & Slots
- Slot Allocation: Campaign participation is managed dynamically. If a campaign hits its maximum slot capacity, the campaign will automatically close, and no further applications will be processed.
- Brand Rights: Brands reserve the right to review application structures, select creators based on proprietary criteria, or reject profiles that violate brand safety guidelines.
4. Financial Terms & Payouts
- All campaign payouts, budgets, and commercial escrow terms are dictated on a per-campaign basis inside the dashboard.
- Payments will only be released after successful verification of the deliverables, adherence to the specific brand guidelines, and confirmation that the content meets the required permanence duration.
- ViralF reserves the right to withhold payouts if a user is found violating authenticity guidelines or using fraudulent execution methods.
5. Third-Party Services & API Integrations
- Our platform integrates with third-party APIs, including Google OAuth 2.0 and the YouTube API Services to sync channel data.
- By using our platform and connecting your YouTube channel, you explicitly agree to be bound by the YouTube Terms of Service and the respective policies of any other connected social networks.
6. Limitation of Liability & Termination
- ViralF shall not be held liable for any indirect, incidental, or consequential damages resulting from campaign disputes, product shipping delays by brands, or social media platform algorithm changes/account suspensions.
- We reserve the right to terminate or suspend your access to the platform immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the business interests of ViralF.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal actions or disputes shall be subject to the exclusive jurisdiction of the courts located in India.
